The Regular meeting of the Board of Trustees and Public Hearing of the Inc. Village of Bellerose was held on Monday, January 22, 2007, at 7:30 PM in the Village Hall,
Present were: Donna Sherrer, Mayor; Mary O'Donoghue, Ronald De Souza, Rosaleen Shea, Michael Brandt, Trustees; Rosemary Stimpfel, Clerk-Treasurer. Excused: Richard G. Handler, Village Attorney.
Mayor Sherrer led all in the Pledge of Allegiance. The minutes of meeting held on December 18, 2006 and Public Hearing was read by Trustee De Souza and on motion made by Trustee O'Donoghue to accept those minutes, seconded by Trustee De Souza, and carried.
Bills to be paid in the period Jan. 1 to 15, 2007 totaling $11,344.32 were reviewed and approved on motion of Trustee Shea, seconded by Trustee De Souza, and carried. (List bills).
Bills to be paid in the period Jan. 16 to 31, 2007 totaling $134,358.19 were reviewed and approved, on motion of Trustee O'Donoghue, seconded by Trustee Shea, and carried. (List bills). Trustee Brandt voted NAY.
Treasurer Stimpfel reported on financial statements of December 31, 2007: General Fund, $516,554.18; Petty cash, $500.00; Time Deposits, $200,000; Revenues, $59,570.44; Expenses, $117,872.20. Treasurer suggested budget transfer to balance funds.
Mayor Sherrer moved to authorize Treasurer to transfers to balance accounts as follows:

Highway/Public Works Comm. Braun stated LIPA has been contacted to repair hole in road near their manhole cover on Superior Road at Tennis Courts.
Fire Commissioner Douglas Christ stated BFD has again applied to FEMA for a couple of grants. He thanked Chief Puglisi who spent many hours completing grants. Thanked the Board of Trustees for appointing Trustee Rosaleen Shea as Liaison to Fire Dept. (Report appended hereto).
Police activity for the month of December 2006: 11 parking and 5 moving violations issued; 1 auto accident. On Tuesday, Feb. 6th at 7 PM to 8:30 PM the 3rd Pct. is hosting a Community Forum at Mineola Middle School. Residents and community leaders are invited.
Supt. of Maintenance Brandt read his report for November 2006 thru January 2007. (Appended hereto).
Trustee De Souza stated he would be setting up a meeting in the New Year with Congresswoman McCarthy and Senator Schumer re: firehouse funding. Will also be sending reminder letters to those who agreed to funding. Maureen O'Connell who is running for State Senator has agreed to honor Sen. Balboni's grants to Bellerose if elected.
Trustee O'Donoghue reported on BDDC meeting of January 2nd. They have been told the County has no money for funding but Mr. Jim Trent is working diligently for grants.
Trustee Shea reported on meeting with Mr. Dan Nachmanoff Director of Local Governmental Relations on Jan. 12th. He also stated he would help with funding projects for Bellerose Village. The Third Track C.A.R.E. committee spoke to Carle Place Civic Association's concerned citizens. Maureen O'Connell was also at this meeting.
Trustee Shea thanked Mayor Sherrer and Alan Woodruff for the preservation of our buildings, and said that we must be cautious at this time re: LIRR/MTA and their statements. Some New Hyde Park residents have received letters from LIRR/MTA asking for their properties. Reminded residents that the Email Alert notice will be extended until March 2007.
Trustee Brandt read his Sanitation Report of November 2006 thru January 22, 2007. (Report appended hereto).
Thomas Mylod reported that the Generator switches have been repaired in both Fire house and Village hall and are in working order.
Traffic Commissioner Margaret Hagan stated Bid opening on new meters is January 31st at 10:30 AM in Village Hall.
Alan Woodruff and Mayor Sherrer to set up Mayoral portraits. He will be attending two conferences on Preservation.
Zoning Board Committee has been meeting regularly and the Committee has agreed to a Moratorium.
Code Committee has read thru 90% of Code and is still reviewing same at regularly scheduled meetings.

Trustee De Souza read the proposed Local Law #3 of 2007. A Local Law amending the Code of the Inc. Village of Bellerose, Chapter 210 thereof, entitled ZONING by adding a new section, to wit: Section 210-48.1 imposing a temporary moratorium upon the issuance of permits for the new buildings and the demolition of, or alterations and additions to, existing building located within the Residence District of the Village of Bellerose, in its entirety. (Appended hereto).
After discussion, Trustee De Souza moved to set the date of February 26, 2007 for a Public Hearing on Local Law #3 of 2007, seconded by Trustee Shea, and carried. Trustee Brandt voted NAY.
The Mayor opened the meeting to the Public at 9 PM. All those who wished to be heard, having been heard, and there being no further call for discussion, Trustee Shea moved to close the business portion of the meeting at 9:45 PM, and open the Public Hearing re: Local Laws #2 of 2007.
Trustee O'Donoghue read Local Law #2 of 2007 in its entirety: A local law amending the Code of the Inc. Village of Bellerose, Chapter 210 thereof, entitled ZONING by amending Section 210-18 (B) to wit: by deleting subsection (4) dealing with gasoline dispensing stations and subsection (8) dealing with automobile showrooms, sales, service and outside storage for new and used cars; renumbering the subsections thereof and adding a new subdivision (F).
After discussion, Trustee De Souza, seconded by Trustee Shea, moved to adopted Local Law #2 of 2007 and carried upon roll call vote as follows: O'Donoghue, AYE; De Souza, AYE; Shea, AYE; Brandt, AYE; Mayor Sherrer, AYE.
The Public Hearing was closed and upon motion of Trustee O'Donoghue, seconded by Trustee De Souza, and carried at 10 PM.
