Legal NoticeNOTICE OF ADOPTION OF LOCAL LAW NO. ONE of 2005 as follows:
PLEASE TAKE NOTICE, that pursuant of Article 9 of the New York State Constitution, the provisions of the Code of the Village of Bellerose and the Municipal Home Rule Law of the State of New York, as amended, a public hearing was duly called and held on March 22, 2005, by the Board of Trustees of the Village of Bellerose on the proposed adoption of Local Laws #1 of 2005, and following the close of the hearing, the Village Board of Trustees duly adopted Local Laws #1 of 2005 a follows:
A Local law amending the Code of the Inc. Village of Bellerose, Chapter 147 thereof, entitled NUISANCES, to add a new section 147.4 to regulate the placement and maintenance of portable basketball hoops and to re-number the existing Section 147.4 to Section 147.5 without change.
BE IT ENACTED by the Board of Trustees of the Inc. Village of Bellerose as follows:
Section 1. Restrictions on the Use of Basketball Hoops: Replace Section 147 as follows:
Section 147-4 (a) No person or entity shall store, leave or utilize a portable basketball hoop in or upon a street, sidewalk, right-of-way, or front yard.
(b) No basketball hoop shall be utilized between the hours of 10:00 P.M. and 8:00 A.M.
Section 2. Re-number existing Section 147-4 to Section 147-5.
Re-number existing Section 147-4 titled "Penalties for offenses" and designates said provision as a new Section 147-5 without any changes.
Section 3. Effective Date.
This local law shall take effect immediately.
